Reservations

Reservations are subject to availability. By paying either a tour deposit or full payment, you will be deemed to have understood and accepted these Terms and Conditions and made a reservation(s) on the nominated Neddy’s Sports Tours tour. Neddy’s Sports Tours will notify the client in the event the booking has been declined and the client deposit will be refunded if one was paid.

Price And Validity

Prices are provided as a guide only and may vary due to changes in taxes or changes due to fluctuations in foreign exchange rates. Please check all prices & information with Neddy’s Sports Tours. Please note that the price of your tour may change at any time if any taxes or changes are introduced or varied, even after you have paid part of the quoted tour price. If we have to change any part of your booking for reasons beyond our control, we will notify you. Goods and Services Tax (GST) - All prices are inclusive of Australian GST were applicable.

Payment Schedule

A 50% non-refundable deposit is required upon booking. A 50% deposit is required from the client upon making a booking to secure a reservation on a tour. The client submitting the booking form warrants that he or she has the authority of the client's therein designated, whether by name or not, to make this booking on their behalf, subject to the conditions contained herein. A tour place is reserved for the client on acceptance of the deposit payment by Neddy’s Sports Tours. Final Payment is due 45 days prior to the tour departure date. Failure to pay the balance owed prior to 45 days before the tour may lead to cancellation of the client's tour reservation. The clients booking is deemed confirmed once full payment has been confirmed as received by Neddy’s Sports Tours. Neddy’s Sports Tours may accept tour bookings after this date subject to availability.

Payment Methods

Clients can pay by credit card (Visa and Mastercard) or direct debit. Client cancellation of booking: 50% booking deposits are non-refundable under any circumstances. Cancellations must be received in writing by Neddy’s Sports Tours. If you cancel or terminate your tour there will be no refund of your tour after full payment has been received by Neddy’s Sports Tours. 100% cancellation fees will apply. Cancellation of airfares/land operators booked and paid for by the client will be pursuant to the terms and conditions applicable to that supplier and agreed between those parties.

Client Cancellation Of Booking

All booking payments (deposit and final payment) are non-refundable under any circumstances. Tour cancellations must be received in writing by Neddy’s Sports Tours.

Tour Cancellation By Neddy’s Sports Tours

Neddy’s Sports Tours reserves the right to cancel tours at any time prior to the departure date in which case any deposit or other payments made on account of the tour shall be refunded to the client subject to Neddy’s Sports Tours receiving refunds from third party providers .i.e. accommodation, meals, tickets. An alternate date, whether suitable to the client or not may be provided in lieu. The client shall have no right to claim damages from Neddy’s Sports Tours. Neddy’s Sports Tours or its third party reserve the right either before or during the tour to refuse to carry or accommodate any client who it reasonably considers, in the light of the best interests of all participants in the tour, to be unsuitable by reason of physical or mental condition or unruly behaviour.

Not Included In Tour Price

The cost of obtaining appropriate passports, visas, travel insurance, excess baggage, vaccinations, all items not specifically mentioned as being included, and all items of a personal nature such as telephone and other communication costs, gratuities (unless specified), meals and beverages (unless specified), laundry, etc. are not included in the tour price.

Products

Descriptions of events, activities and hotels are based on current domestic and international guides and information provided by hotels and suppliers. Any facilities shown as included are subject to change without notice at any time. Neddy’s Sports Tours has made every effort to ensure this information is accurate at time of publication.

Travel Insurance

Comprehensive travel insurance (including full medical coverage) is highly recommended. Purchase and acceptance of travel insurance cover for a Neddy’s Sports Tours tour is the responsibility of the client not Neddy’s Sports Tours.

Itineraries And Schedules

Neddy’s Sports Tours or any of our suppliers reserves the right to alter any part of the suggested itinerary. Notice will be given prior to departure if changes have been made. Any activities undertaken by the client outside of the Neddy’s Sports Tours published itinerary will be the sole responsibility of the client.

Passports & Visas

If participating in one of Neddy’s Sports Tours overseas tours you must ensure your Australian passport has a validity of six months after your return date to Australia. In the event that you are travelling to a country or countries other than those included in the Neddy’s Sports Tours tour and which do not require a visa for Australian passport holders, you must advise Neddy’s Sports Tours if you have been arrested or convicted in respect of any offence or breach of law. Non-disclosure of this information may lead to your being refused entry on arrival in certain countries. In that event, we take no responsibility whatsoever. If you do not wish to disclose such information to us, then you must contact the embassy of each country of destination and make your own arrangements in regard to entry to that country. It is the responsibility of the passenger to ensure he or she is in possession of travel documents and that they are in compliance with the current government and transportation company's regulations.

Unused Tour Services

Unused vouchers for services that are provided as part of a Neddy’s Sports Tours tour package are non-refundable and not transferable.

External Impacts On Neddy’s Sports Tours Activities Or Events

Tickets to specific events or activities covered under a Neddy’s Sports Tours tour cannot be exchanged or refunded separately. This includes but not limited to, the possible non-appearance of any particular person, group or personality expected by the client, whether advertised or not. These circumstances include any adverse weather conditions or any circumstances beyond the reasonable control of Neddy’s Sports Tours. Neddy’s Sports Tours is not obliged to replace an event or activity ticket under any circumstances, including but not limited to, loss or theft. Neddy’s Sports Tours reserves its rights, however, to replace an activity or event ticket which has been lost or stolen and charge a fee for that replacement, in its sole and absolute discretion. Where event or activity tickets are supplied to the client, Neddy’s Sports Tours bears no responsibility for the location of seating within the match/event venue. Tickets to events or activities may not be sold, on-sold, exchanged for fee or reward or other valuable consideration or otherwise commercially dealt with. If a Ticket has been dealt with in contravention of this condition, Neddy’s Sports Tours may cancel the client’s access to that event or activity. Neddy’s Sports Tours tours and Tickets therein shall not be used as competition prizes, or trade incentives, nor may they be used in raffles, lotteries or draws whether for commercial or charitable purposes without the prior written authority of Neddy’s Sports Tours, which may withhold such authority at its sole discretion.

Destination Information

Neddy’s Sports Tours makes no representations as to the safety, conditions, or other issues that may exist at any destination. International travel advice can be obtained from various sources including local government, local Consular offices and the Australian Department of Foreign Affairs and Trade (www.smarttraveller.gov.au).

Clients With Disability

It is the responsibility of passengers with a disability or requiring assistance to notify Neddy’s Sports Tours at the time of booking so appropriate assistance can be arranged.

Liability Waiver

By paying either a tour deposit or full payment, the client hereby indemnifies Neddy’s Sports Tours from and against any and all costs, damages and expenses, including but not limited to legal fees, which are incurred by the client, its agents, employees and guests, or for which Neddy’s Sports Tours becomes liable as a result of the conduct of the customer, its agents, employees and guests. Neddy’s Sports Tours does not accept any liability for the acts, omissions or default, whether negligent or otherwise, of persons providing services in connection with the passenger's package and over whom Neddy’s Sports Tours have no control. Neddy’s Sports Tours shall not be liable for any injury, damage, loss, accident, delay or irregularity that may be caused or arising during any tour under its management, sponsorship, procurement, or otherwise notwithstanding that the Company's principal may be a foreign company, corporation or person. The transportation companies or firms shall be exempt from liability in respect of any detention, delay, loss, damage, sickness or injury however and by Whomsoever caused and of whatever kind occurring of or to passengers at any time when the passenger is not on board a carrier or conveyance used or operated by the transport companies or firms.

Activities Exclusion Waiver

Neddy’s Sports Tours will not be liable for any loss, injury, damage, liability or expense arising directly or indirectly out of the following activities; BUNGEE JUMPING, CANYONEERING, CAVING, HANG GLIDING, HELI-HIKING/HELI-SKIING, HORSE RIDING AND OTHER RELATED EQUINE RELATED ACTIVITIES, HOT AIR BALLOON RIDES, HUNTING, CLIMBING, FISHING, MOTORCYCLE/ATVS, MOUNTAIN BIKING, PARASAILING, PROFESSIONAL SPORTS, ROCK/ROPE CLIMBING, RAPPELLING, ZIP LINE, SCUBA DIVING, SKIING AND SNOWBOARDING, STAG AND HEN PARTIES, WHITE WATER ACTIVITIES (CLASS 3-5 WATER), WORKING HOLIDAY RANCH AND LODGES, RACING, POLO PLAYING, HANG GLIDING, TREKKING, HELICOPTER ACTIVITIES, WATER SKIING, SNOW MOBILES, RODEOS, BASE JUMPING, CONTACT SPORTS, MOUNTAINEERING, SURFING, PARACHUTING, PARAGLIDING, CAGE DIVING, MOTOR SPORTS (MOTORCYCLES, QUAD BIKES, SPEED BOATS).

Communicable Disease Exclusion Waiver

1. Neddy’s Sports Tours will not be liable for any actual or alleged loss, liability, damage, compensation, injury, sickness, disease, death, medical payment, defence cost, quarantine cost, cost, expense or any other amount, directly or indirectly and regardless of any other cause contributing concurrently or in any sequence, originating from, caused by, arising out of, contributed to by, resulting from, or otherwise in connection with a communicable disease or the fear or threat (whether actual or perceived) of a communicable disease.

2. For the purposes of this endorsement, loss, liability, damage, compensation, injury, sickness, disease, death, medical payment, defence cost, quarantine cost, cost, expense, or any other amount, includes but is not limited to, any cost to clean up, detoxify, remove, monitor, or test for a communicable disease.

3. as used herein, a communicable disease means any disease which can be transmitted by means of any substance or agent from any organism to another organism where:

3.1. The substance or agent includes, but is not limited to, a virus, bacterium, parasite or other organism or any variation thereof, whether deemed living or not, and

3.2. The method of transmission, whether direct or indirect, includes but is nnot limited to, airborne transmission, bodily fluid transmission, transmission from or to any surface or object, solid, liquid or gas or between organisms, and

3.3. The disease, substance or agent can cause or threaten bodily injury, illness, emotional distress, damage to human health, human welfare, or property damage.
